Code of Conduct
of the MOTA Group ( version 12/11/2012)
The « Constructions Mécaniques Mota »company and its subsidiaries
« MOTA SA », « FBA » ,« MOTA North America » enjoys an excellent image with all third parties in contact with its employees.
This reputation extends beyond our borders, given the international nature of their activities. The Mota Group ,throughout its growth, intends to ensure and continuously promote the compliance with rules, behaviours and moral values that have created this reputation.
The Mota Group Code of Conduct has been established in complement and without contradiction with :
- The current “Mota Rules of Procedures” booklet
- The “Declaration from management” document
in order to underscore the principles and values by which each member of the Group,employees,managers,directors, commit to conduct his relations with any people, in relation with one of the company of the Group.
It is, moreover, asked to the staff of the group to encourage their professional relations, suppliers,business partners,… to adopt the same approach.
General business principles
Legal compliance :
In every country in which it operates,the local or national laws and regulations are applied.The principles of this Code of Conduct have to be applied each time the law does not give any guidance .
Behaviour and rules towards business partners :
Intellectual honesty and rigor are the basic principles that characterize the behavior of the Mota group towards all its customers and business partners.
The member of the Group shall not offer customers, potential customers,unions, or any representatives of such entities, any rewards or benefits in violation of either applicable laws or reasonable and generally accepted business practices.
Similarly, the Mota Group employees must not accept payments, gifts, or other kinds of reimbursement from a third party that could affect or appear to affect their objectivity in their business decisions.
Accounting principles :
All financial transactions by the Mota Group are registered in accordance with the current accounting rules and are annually audited by two independant companies in order to provide a truthfull,relevant and sincere annual Balance Sheet and Profit and Loss report.
Conflicts of Interest :
Every member of the Group , employees, directors, shall conduct their private and other external activities and financial interests in a manner that does not conflict or appear to conflict with the interests of the Group.
Political Involvement :
The Mota Group observes neutrality with regard to political parties and candidates.
Environmental Principles
Resource efficiency :
Mota Group products and processes are designed in such a way that energy and raw materials are used efficiently, and waste and residual products are minimized over the products’ life cycles.
Precautionary Principle
The Mota Group supports the precautionary principle by avoiding materials and methods posing environmental and health risks when suitable alternatives are available.
A continuous survey is organized in order to minimize any impact of environnement.
Human Rights and Workplace Practices
Human Rights :
The Mota Group , within its sphere of influence supports and respects the protection of internationally proclaimed human rights and ensures that it is not complicit in human rights abuses.
Non-Discrimination :
The Mota Group hires and treats its employees in a manner that does not discriminate with regard to gender, race, religion, age, disability, sexual orientation, nationality, political opinion, union affiliation, social or ethnic origin.
Labor Policy :
No form of forced, compulsory or child labor is tolerated in the Mota Group.The regulations about ’Labor Rights’ are respected and an organization is in place to prevent or detect any deviation.
Work Environment :
The work environnemnt is audited in regular base in order to ensure the safety and the health of workers.
Responsibility of Managers and Employees
It is the responsibility of Mota Group managers to communicate and demonstrate the content as well as the spirit of this document within their organizations, and to encourage employees to reveal behavior that may be non-compliant with these principles.
Any violation of this code may be reported anonymously and confidentially to the General Secretary and the Direction via the ’Délégués du Personnel’ ou ’Délégation unique du personnel’ Committee .
Persons reporting violations in good faith will not be subject to retaliation.
The “Mota Rules of Procedures” booklet (Art 15-10) further stipulates the procedure to apply, for anyone who feels victim of sexual or psychological harassment or violence at work.
This Code of Conduct refers to the current “Mota Rules of Procedures” booklet : therefore, failure to comply with its provisions can result in disciplinary action.
This Code of Conduct has been presented and adopted by the Board of Directors of Constructions Mota and can only be amended or waived by this Board.
